WHO WE ARE
40 Days for Life® (“40 Days for Life”) is a registered charitable organization organized under the laws of the State of Texas, U.S.A and Section 501C3 of the Internal Revenue Code of the United States of America. 40 Days for Life operates globally.
Local campaigns and vigils (“campaigns”), both inside and outside of the U.S.A. are legally separate and independent from 40 Days for Life and operate independently. Personal data collected and/or used by local campaigns are not controlled by 40 Days for Life and are not covered by this Statement.
PURPOSE OF THIS STATEMENT
This Statement informs you of the privacy principles that govern our use of personal data that we obtain from our users, leaders and participants, who are residents of the European Union (“EU”) or the European Economic Area (“EEA”); including information we obtain through our websites and applications, including 40daysforlife.com, our mobile APP and other websites owned or controlled by Days for Life (“Applications”).
For residents of the EU or EEA, the General Data Protection Regulation (“GDPR”) takes effect as of May 25, 2018 and requires additional privacy protections for Eu and EEA residents.

40 Days for Life takes your privacy seriously and takes all reasonable means to protect your personal data and identity.
No one can guarantee complete security – so if you have concerns that your use of 40 Days for Life Applications is not secure, you should cease use and contact us immediately.
This Privacy Statement (“Statement”) applies to all of the 40 Days for Life Applications in which we collect, store, access, transfer and/or use personal data.
Our Applications are available to users throughout the world, and are used for varying purposes, including: To provide information and education; to answer inquiries about our Mission; to register leaders, campaigns and participants for local campaigns; to train leaders; to provide support; to solicit donations and financial contributions; and to provide 40 Days for Life books and merchandise through our on-line store. Certain Applications and uses may not be available in all locations.
Our Applications are controlled and operated from the United States of America (“U.S.A.”) in accordance with laws of the U.S.A and users should be aware that the laws of the U.S.A. may differ from local laws.
WHO HAS ACCESS TO YOUR PERSONAL DATA
Sharing your personal data.
Your personal data may be shared with other companies that are wholly owned by 40 Days for Life and the following third parties for the purpose described in this Privacy Policy:
a. Government authorities, law enforcement bodies and regulators as may be required by law or competent court order;
b. Trusted service providers we are using to run our Mission, such as third-party software providers, shipping specialists, fulfillment specialists and website managers, cloud service and e-mail service providers assisting our advancement and fulfillment team;
e. Banking, credit and debit card companies which facilitate your payments to us, and anti-fraud screening;
f. Legal and other professional advisers;
g. Our trusted third party ancillary partners (identified on our website) who offer Mission-related products and services on our website; we and our partners may collect and share information about you, such as your contact details and your billing information. We are not responsible for third parties’ use of your personal data where such use is permitted for their own purposes. Please consult their privacy policies for further information;
h. Social media: You may be able to access third party social media services through our website or App or before coming to our website or App. When you are registered with your social service account, we will obtain the personal information you choose to share with us through these social media services pursuant to their privacy settings in order to improve and personalize your use of our website or App. We may also use social media plugins on our website or App. As a result your information will be shared with your social media provider and possibly presented on your social media profile to be shared with others in your network. WHAT PERSONAL DATA WE COLLECT
Our Applications may collect personal data when you register, make an inquiry and/or place an order for products or services.
“Personal Data” is data that identifies you as an individual or relates to an identifiable individual and may include your:

HOW WE COLLECT PERSONAL DATA
We and our third-party service providers may collect personal data in a variety of ways, including:

Through your browser or device:
Certain personal data is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version and the name and version of the Online Services (such as the Apps) you are using, in order to ensure that the Online Services function properly.
Through your use of the Apps:
When you download and use an App, we and our service providers may track and collect App usage data, such as the date and time the App on your device accesses our servers and what information and files have been downloaded to the App based on your device number.

Using pixel tags and other similar technologies:
Pixel tags (also known as web beacons and clear GIFs) may be used in connection with some Online Services to, among other things, track the actions of users of the Online Services (including email recipients), measure the success of our marketing campaigns and compile statistics about usage of the Online Services and response rates. We also use Google Analytics and Adobe Analytics, which uses cookies and similar technologies to collect and analyze information about use of the Services and report on activities and trends. These services may collect information regarding the use of other websites, apps and online resources. Using Adobe Flash technology (including Flash Local Shared Objects (“Flash LSOs”)) and other similar technologies:
We may use Flash LSOs and other technologies to, among other things, collect and store information about your use of the Online Services. If you do not want Flash LSOs stored on your computer, you can adjust the settings of your Flash player to block Flash LSO storage using the tools contained in the Website Storage Settings Panel. IP Address: Your IP address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). An IP address may be identified and logged automatically in our server log files whenever a user accesses the Online Services, along with the time of the visit and the page(s) that were visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications and other services. We use IP addresses for purposes such as calculating usage levels, diagnosing server problems and administering the Online Services. We may also derive your approximate location from your IP address. Physical Location & Mobile Location-Based Services: We may collect the physical location of your device by, for example, using satellite, cell phone tower, WiFi signals, or other technologies. We may use your device’s physical location to provide you with personalized location-based services and content, including enabling you to find a campaign near you.
If you have downloaded one of our Apps, you may enroll to receive special offers by agreeing to the use of technologies that enable us to collect information about you through your mobile device’s Bluetooth or similar capabilities. We will collect this information if you opt-in through the App (either during your initial login or later) to receive the special offers and by enabling these capabilities on your mobile device. If you have done so, the App will continue to collect location information Maruntil you log off (i.e., the App will collect this information if it is running in the background) or use your phone’s or other device’s setting to disable your mobile device’s applicable similar capabilities for the App.
By aggregating information:
Aggregated Personal Information does not personally identify you or any other user of the Services (for example, we may aggregate Personal Information to calculate the percentage of our users who have a particular telephone area code).
THIRD-PARTY INFORMATION PROVIDED BY YOU
If you submit any Personal data relating to other people to us you represent that you have the authority to do so and to permit us to use the personal data in accordance with this Statement.
HOW WE USE YOUR PERSONAL DATA
We will use this personal data for:
- Event and campaign registration
- Training
- Providing information, goods and services requested
- Maintaining your account and records
- Sending you information related to 40 Days for Life and our Mission.
- Obtaining payment for purchases
Sending you administrative information, marketing communications, promotional offers, periodic customer/user satisfaction, market research or quality assurance surveys
Allowing you to participate in contests and other promotions and to administer these activities
Business purposes, such as data analysis, audits, security and fraud monitoring and prevention, developing new and improved methods, services and products, enhancing, improving or modifying our services, identifying usage trends, determining the effectiveness of our campaigns and operating and expanding our activities.

DISCLOSURE AND SHARING OF YOUR PERSONAL DATA
40 Days for Life will not share your personal data with individuals or entities outside of 40 Days for Life unless specifically agreed to by you or as may be required to do so by law.
Access to your personal data and correction
If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out by visiting our unsubscribe link and following the instructions.
We will try to comply with your request(s) as soon as reasonably practicable, but in no event in longer than 30 days.
In your request, please make clear what Personal data you would like to have changed, whether you would like to have your Personal data suppressed from our database, or other limitations you would like to put on our use of your Personal data. We may only implement requests with respect to the Personal data associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request.
Retention:
We will retain your Personal data for the period necessary to fulfill the purposes outlined in this Privacy Statement and to fulfill your requests, unless a longer retention period is required or permitted by law or you have requested deletion; but in no event will we retain your personal data in excess of twenty-four (24) months without your re-consent.
CROSS BORDER TRANSFERS OF PERSONAL DATA
40 Days for Life is global. Sharing personal data cross border is essential.
We may, subject to applicable law, transfer Personal and Other Information collected in connection with the consents provided by you only, to countries where information protection standards may differ from those in the country where you reside. By giving your consent and using our Applications, you understand that we may transfer your personal data globally.
Your data will be transferred and stored and accessed and processed at least to the U.S.A.
